FAQ

I lost my I-94 and filed Form I-102. What if USCIS don't find any record?
I agree with one of the other answers that this is unlikely to be a problemespecially if you entered recently and provided the correctcomplete info forthe passport on which you entered. But let’s suppose this entry was before the electronic system came in a fewyears back and that this was issued as a paper I94 stapled into the passport. It then becomes important to provide as much information and documentation aspossible about the ext place you entered as well as the date time and means copy of passport rubber stamp from entry old boarding passes statingarrival time are great old frequently flyer records are helpful as well. The old records weren’t computerized and they literally have to searchthrough files for the rest of that white card you would have filled out on theplane or whatever means of transport before entering. Anything that helpsguide them to the right file helps your chances that they find the record ofyour arrival.

Is it safe to leave the US to apply for a J-1 visa if you have overstayed yourdeparture date on a Form I-94 B1 visa?
Depending on how much of a time you accrued on your overstay after the date onyour I94 record you may have a ban from entering the US. If your overstay isbetween 180 and 365 days you have a 3 years long ban. If your overstay isover 365 days you have a 10 year ban. If your overstay is less than 180 daysyou do not have a ban but in either of these cases you rendered your B1B2visa useless. You will need a new one and when you apply for it the question“why did you violate your visa terms ” question will definitely come up. Youhad better have a good and plausible answer for that. Because you have provenonce that you are a flight risk you need to convince the consular officerthat you are not so by explaining why did you have to overstay your visa. Itain’t gonna be easy.

You have two options You can apply for Extension of Status in the US to extend your status. Note that for L1 status this can only be done by your employer filing an I129. You can leave the US and reenter with a new passport along with your existing valid visa in your old passport.
